Welcome to Nelmi! This store is operated by NELMI STORE LLC, a New Jersey limited liability company doing business as Nelmi. The terms “Nelmi,” “we,” “us,” and “our” refer to NELMI STORE LLC.
Nelmi operates this store and website, including all related information, content, features, tools, products, and services (the “Services”). Nelmi is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with the policies referenced herein (the “Terms”), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include information about orders, returns, warranty disclaimers, and limitations of liability.
By visiting, interacting with, or using our Services, you agree to these Terms and acknowledge that you have read our Privacy Policy. If you do not agree to these Terms, you should not use the Services.
Nothing in these Terms excludes or limits consumer rights, warranties, or remedies that cannot be excluded or limited under applicable law.
SECTION 1 - ACCESS AND ACCOUNT
By using the Services to place an order, you represent that you are at least the age of majority in your state of residence or are acting with the permission and supervision of a parent or legal guardian authorized to make the purchase.
To use certain features of the Services or purchase products, you may be asked to provide information such as your email address, billing address, payment information, and shipping address. You represent that the information you provide is accurate, current, and complete and that you are authorized to provide it.
You are responsible for maintaining the security of your account credentials and for activity conducted through your account. Please notify us promptly if you suspect unauthorized use. You may not transfer, sell, assign, or license your account to another person without our permission.
SECTION 2 - OUR PRODUCTS
We make reasonable efforts to display and describe our products accurately. Colors and appearance may vary slightly depending on your device, screen settings, lighting, and normal manufacturing variations.
These possible variations do not affect your rights if a product is defective, materially different from its description, or otherwise does not conform to your order.
Product descriptions, availability, and selections may change. We may discontinue products or limit quantities. Changes to a product description after you place an order do not change the agreed specifications of that order without your consent.
When personalization is offered, please review the initials, names, spelling, capitalization, and other details you submit before completing your purchase. Personalized items are subject to the exclusions and exceptions described in our Return and Refund Policy.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. We may accept or decline an order, subject to applicable law, including where a product is unavailable, payment cannot be verified, an error affects the order, or we reasonably suspect fraud or unauthorized activity.
An automated order-receipt email confirms that we received your order. Your order is accepted when we send a shipping confirmation or otherwise expressly confirm acceptance.
Please review your order carefully before submitting it. If you need to request a change or cancellation, contact hello@nelmi.store as soon as possible. We may be unable to accommodate changes or cancellations once fulfillment or personalization has begun. This does not affect cancellation or refund rights provided by applicable law.
If we decline or cancel an order after payment has been collected, we will notify you and refund the amount paid for the canceled items and any applicable associated charges. We will not substitute a materially different product or increase the agreed price without your consent.
Returns and exchanges are governed by our Return and Refund Policy, subject to applicable law.
Products are offered for personal or household use. Commercial resale or bulk purchasing arrangements require our prior agreement.
SECTION 4 - PRICES AND BILLING
Prices are shown in U.S. dollars unless otherwise indicated. Prices, discounts, and promotions may change, but changes do not alter the agreed price of an accepted order.
Applicable taxes and shipping charges are displayed at checkout before you submit your order. Unless expressly stated, displayed product prices do not include these charges.
Promotions may be subject to separate terms disclosed with the offer. If promotional terms conflict with these Terms, the promotional terms govern that promotion to the extent permitted by law.
You agree to provide accurate and complete purchase, payment, and account information and to update information as necessary for us to process your transaction or contact you.
You represent that you are authorized to use the payment method provided and agree to pay the total amount displayed at checkout.
SECTION 5 - SHIPPING AND DELIVERY
Available shipping destinations, charges, order processing times, and estimated transit times are described in our Shipping Policy and at checkout. Order processing time is separate from carrier transit time.
Carrier delivery estimates are not guaranteed unless expressly stated. If we cannot ship your order within the stated processing time, we will notify you and offer a revised shipment date or cancellation and a refund, as required by applicable law.
Please provide a complete and accurate shipping address. If you discover an address error, contact us promptly. We may be unable to change the address after an order has entered fulfillment or been shipped.
If your package is lost, arrives damaged, or shows as delivered but cannot be located, please contact hello@nelmi.store. We will investigate with the carrier and arrange an appropriate resolution.
Nothing in this section limits your rights under applicable law.
SECTION 6 - INTELLECTUAL PROPERTY
The Services, including our text, photographs, graphics, videos, logos, designs, and the selection and arrangement of content, are owned by Nelmi or used with permission from the applicable rights holders and are protected by intellectual property laws.
You may access and use the Services for personal, non-commercial purposes, including browsing products and making purchases. You may not reproduce, distribute, modify, create derivative works from, commercially exploit, or republish protected content without permission, except as permitted by applicable law.
Nothing in these Terms grants you ownership of or a license to our trademarks or other intellectual property, except for the limited permission necessary to use the Services as intended.
Nelmi’s names, logos, product names, and designs may be trademarks of Nelmi or the applicable rights holders. Shopify’s names and logos are trademarks of Shopify. Other trademarks appearing on the Services belong to their respective owners.
SECTION 7 - OPTIONAL TOOLS
We may provide access to tools or features offered by third parties. Their availability and operation may depend on those providers and may be subject to additional terms.
To the extent permitted by law, optional third-party tools are provided “as is” and “as available,” without additional warranties from Nelmi. We do not control every aspect of their operation.
Before using an optional third-party tool, review the relevant provider’s terms and privacy information.
New features or services we introduce will be subject to these Terms unless separate terms are provided.

The Services may contain links to websites or materials operated by third parties. A link does not necessarily imply endorsement.
We do not control third-party websites and are not responsible for their content, products, services, or privacy practices. Please review the applicable third-party terms before providing information or completing a transaction.
Questions about products or services purchased directly from a third party should be directed to that provider. This section does not limit our responsibilities for purchases made directly from Nelmi.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Nelmi is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Nelmi. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Nelmi, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Nelmi.
SECTION 10 - PRIVACY POLICY
Personal information collected through the Services is handled as described in our Privacy Policy. Certain information may also be subject to Shopify’s Consumer Privacy Policy.

This permission does not allow us to misrepresent your views or override applicable privacy rights. Private customer-service correspondence is not treated as a public testimonial without permission.
You represent that you own or have permission to submit your Feedback and that it does not infringe another person’s rights. You must disclose any compensation or incentive connected with a review where required by law.
Feedback must not contain unlawful material, threats, personal information you are not authorized to disclose, or malicious software. You must not submit fake reviews or impersonate another person.
We may moderate Feedback for these reasons, but we do not prohibit or penalize honest negative reviews solely because they are unfavorable.
We are not obligated to pay for unsolicited Feedback or respond to every submission.

14.2 Agents may access the Services only where permitted by us and must comply with these Terms and applicable technical restrictions. We may limit or discontinue Agent access.
14.3 Agents must identify themselves accurately. In HTTP or HTTPS requests, an Agent must identify itself in its user-agent string using “Agent/[agent name],” replacing the bracketed text with the Agent’s actual name.
14.4 Agents must not conceal their automated nature, impersonate humans, bypass CAPTCHAs, evade security measures, or circumvent restrictions on access. They must respond truthfully to requests to identify whether an interaction is automated.
14.5 An Agent may submit an order or other instruction on your behalf only with your authorization. The use of an Agent does not remove any consumer rights that apply to your purchase.

We may suspend or terminate access to the Services where reasonably necessary to address a breach of these Terms, fraud, security concerns, or a legal requirement.
Termination does not eliminate rights or obligations arising from orders already placed, including applicable refund rights and payment obligations.
Provisions that by their nature should continue after termination will remain effective, including provisions concerning intellectual property, privacy, liability, dispute resolution, and outstanding obligations.
SECTION 16 - DISCLAIMER OF WARRANTIES
We aim to provide accurate information and reliable Services, but we cannot guarantee that the website will always be available, uninterrupted, or free from technical errors.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND OPTIONAL ONLINE TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ADDITIONAL WARRANTIES OF ANY KIND.
THIS DISCLAIMER DOES NOT EXCLUDE WARRANTIES OR CONSUMER PROTECTIONS THAT APPLY TO PRODUCTS BY LAW, EXPRESS PRODUCT PROMISES WE MAKE, OR OUR OBLIGATIONS UNDER OUR RETURN AND REFUND POLICY.

SECTION 17 - LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY APPLICABLE LAW, NELMI AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL LOSSES ARISING FROM USE OF THE WEBSITE, INCLUDING LOST BUSINESS PROFITS OR BUSINESS OPPORTUNITIES.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, PERSONAL INJURY WHERE LIABILITY CANNOT BE LIMITED, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
These limitations do not remove your rights concerning defective or misdescribed products, required refunds, or other mandatory consumer remedies.

We will notify you of a claim for which we seek indemnification and provide a reasonable opportunity to participate in its defense. We will not agree to a settlement imposing an admission or non-monetary obligation on you without your consent.

They do not override express commitments made in an accepted order or rights that cannot be waived under applicable law.

Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms to the extent permitted by law.
